Food and Drug Administration’s (FDA) enforcement involves sending warning letters to entities within its jurisdiction, with some becoming publicly visible weeks or months after dispatch. Business owners are allotted 15 days to reply, but warning letters are typically issued after companies have had months to years to address issues.
A North Carolina-based food firm, Gate City Hemp North Carolina (GCHNC) LLC dba Hemp XR, received an FDA warning for violating federal regulations by introducing cannabidiol (CBD) and Delta-8 Tetrahydrocannabinol (THC) products into interstate commerce.
The FDA’s review of Hemp XR’s website revealed that several products, including Far Out Candy 500MG Delta 8 Cookies and Hemp XR Delta 8 Stoner Candy Gummies, contained unsafe food additives. The use of Delta-8 THC and CBD in these products lacks FDA approval and violates food additive regulations.
The FDA has issued a warning letter, stating that the introduction of these adulterated products into interstate commerce is prohibited. GCHNC LLC dba Hemp XR must address the violations within 15 days to comply with FDA regulations.
