FDA warns seafood importer over failure to verify foreign processing meets HACCP standards

In a Jan. 16, 2026, warning letter, the Food and Drug Administration cited serious violations of the seafood Hazard Analysis and Critical Control Point (HACCP) regulation at Feng Foods Trading Inc., a seafood importer in New Hyde Park, NY.

During an inspection on Nov.  20, 2025, FDA determined the company failed to implement an affirmative step to ensure imported fish and fishery products were processed in compliance with U.S. HACCP requirements, as required.

 

The imported products deemed adulterated because they may have been prepared, packed, or held under insanitary conditions whereby they may have been rendered injurious to health, include:

  • Granular Ark, Yellow Croaker, and Razor Clam from (redacted by FDA) in (redacted by FDA)
  • Frozen Anchovy from (redacted by FDA) in (redacted by FDA)
  • Fish Roe Prawn Paste from (redacted by FDA) in (redacted by FDA)

Noncompliance may result in refusal of admission for the implicated products, placement on detention without physical examination (DWPE), seizure, injunction, or other enforcement actions.

The company is responsible for ensuring its seafood importer establishment operates in compliance with the Act and 21 CFR Part 123. It must respond in writing within 15 working days with specific corrective steps, including documentation such as HACCP and importer verification records and evidence of implemented affirmative steps.
