In preparation for the implementation of Rule 204 under the Food Modernization Act, former FDA deputy commissioner Frank Yiannas advises companies to proactively embrace technological advancements. Yiannas, a key figure in drafting the rule, stresses the importance of early action to meet its requirements, despite enforcement not commencing until 2027.

Yiannas cautions against relying solely on Advanced Shipping Notices (ASNs) as a shortcut to compliance, citing concerns about their effectiveness in ensuring food safety traceability. Instead, he advocates for a focus on critical events like shipping and receiving records, emphasizing the need for accurate information to prevent potential discrepancies during foodborne illness outbreaks.

Highlighting a cost-effective alternative, Yiannas introduces Wiliot’s advanced tracking technology, which surpasses traditional RFID systems. Steve Statler, CMO of Wiliot, explains the system’s efficiency, utilizing postage stamp-sized sensors that provide real-time data without requiring manual input. This innovative solution not only meets the requirements of Rule 204 but also offers additional benefits such as temperature tracking.

Despite the rule’s implementation being set for 2026, Yiannas emphasizes the importance of companies transitioning now to ensure readiness. While FDA enforcement is scheduled to begin in January 2027, the agency aims to encourage voluntary compliance through advisory action letters before resorting to enforcement measures.
